• DEPARTMENT OF STATE Wa s hington D C 20520 January 15 1976 MEMORANDUM TO L - Mr Monroe Leigh FROM L - Michael Sandler SUBJECT MS HAK Interrogatories in Halperin Suit and the Safire Request Memoranda of HAK's telephone conversations are mentioned three times in the Responses to Plaintiffs' Interrogatories on pages 5 9 and 46-47 On page 5 it states that brief summaries of conversations were prepared that the summaries were not complete and that they may not be entirely accurate On page 47 it says simply that records were prepared in accordance with routine government practice in order to facilitate implementation and follow-up of business transacted At no point and contrary to what William Safire states in his editorial of this morning does it state that verbatim records were prepared On page 5 it states that the telephone records were examined and that this examination did not disclose any conversations concerning Morton Halperin or the wiretap program for the period prior to May 9 1969 There is no mention in the interrogatories of whether the Halperin wiretap is referred to in records of telephone conversations that occurred after May 9 1969 -- but note that curiously the interrogatories do not call for this information for the post - May 9 1969 period If the Halperin wiretap is mentioned in telephone records after May 9 1969 those records would have been subject to Judge Smith ' s impoundment order of June 28 1973 On pages 5 and 6 there is a summary of the HAK telephone records which contain a general discussion of leaks Some of these records may be encompassed by the second of William Safire 's FOI r e que sts ----- I I IED - ·cy JNQ tfS b 1 UthOfl • - 2 - • The Responses to Plaintiffs' Interrogatories also contain two general references to other telephone calls one with President Eisenhower page 2 and one with Chairman Wheeler of the Joint Chiefs page 4 If written records of these conversations exist they could conceivably become the subject of future FOI requests The authorization of the wiretap program and HAK's relationship to that program are discussed at length The most s gnificant references are on pages 17-18 25 28 29 and 33 L MDSandler dc ·- ' j J CLASs i DJ ' '' • - I ·Audio NNO ii §i _ Jfil
